Beweis des ersten Anscheins: Erfahrungswerte gehen grundsätzlich vom Alleinverschulden des Auffahrenden aus
„Es kommt darauf an“ ist eine Art erstes Gebot in der juristischen Bewertung von Sachverhalten. Dagegen spricht der sogenannte Anscheinsbeweis, der sich auf Erfahrungswerte aus ähnlich gelagerten Fällen speist. Wer sich auf den erstgenannten Grundsatz stützen will, braucht stichhaltige Beweise, an denen es dem Beklagten eines Auffahrunfalls fehlte, der vor dem Schleswig-Holsteinischen Oberlandesgericht (OLG) stand.
